What happens in collaborative cases when there is a proposal that differs from a court outcome?
How comfortable are we, as collaborative professionals in all disciplines, review attorneys and mediators, in “allowing” that to happen?
If it is a proposal, and not yet an agreement, from our client, how do we respectfully and gently and wisely advocate for it?
If we are representing the spouse on the receiving end of such a proposal, how open are we to entertaining it.
Please be prepared to discuss your own experiences with these kinds of scenarios.
Teresa Ombres is a divorce mediator, attorney and collaborative attorney, with a private practice in Great Neck, New York. Teresa is a past member of the Board of the Family and Divorce Mediation Council of Greater New York, where she served as Co-chair of the Education Committee. She also spent several years on the Board of the New York Association of Collaborative Professionals. She is a founding member of the New York Chapter of the Association of Family and Conciliation Courts where she served on the Executive Board for over twenty years. Teresa is a current Board member of FamilyKind. She is also a member of the New York State Bar Association, Queens and Nassau County Bar Associations, Queens Women’s Bar Association, Family and Divorce Mediation Council of Greater New York and the New York Association of Collaborative Professionals.
In the beginning of her mediation career Teresa worked at Community Mediation Services in Jamaica, Queens, first at the director of the Bayside Satellite office and later managing the first pilot program in Custody-Visitation Mediations at the Queens Family Court. She taught the Judicial Matrimonial ADR Externship at St. John’s School of Law, and now teaches the Family Law Practicum at the Maurice A. Deane School of Law at Hofstra University. Teresa is a graduate of Fordham University and New York Law School.

Adam Halper is a mediator, collaborative attorney and parenting coordinator. He guides individuals and businesses through conflict, turning challenges into practical, lasting solutions. He has represented clients in a variety of litigation and transactional areas and brings strong business, legal and interpersonal acumen to client issues and conflicts. Currently, in addition to his private law and mediation practice, he is on the roster of neutrals for several New York State Courts and for the District Courts for the Southern and Eastern Districts of New York. Mr. Halper began his career representing domestic violence survivors at Legal Services-NYC, the nation’s largest public interest law firm. Prior to opening a private practice, he was the Director of the Legal Wellness Institute at The Family Center, a unique multidisciplinary organization that serves individuals and families affected by severe illness. There, he led a team of attorneys, paralegals, law students and pro bono volunteers in the representation of thousands of New Yorkers. He has written extensively about his work with vulnerable populations, access to justice and mediation.
