One of the most commonly misunderstood and underestimated aspects of divorce proceedings is language as it pertains to QDROs (Qualified Domestic Relations Order) and the parties’ retirement assets. Denisa will discuss the pitfalls of certain QDRO language contained within Stipulations of Settlement as well as the areas where practitioners are most vulnerable to malpractice lawsuits. Further, she will discuss the most common ambiguous or incorrect language that attorneys mistakenly place within their agreements as it pertains to QDROs which can expose their clients to further litigation post-judgment. Denisa will also cover how to use QDRO to collect past-due child support and will offer practice management tips to speed up what’s known to be a tedious and dragged out QDRO process.
