REGISTRATION

This presentation will include considerations underlying prenup agreements, common misconceptions and best practices leading to a productive negotiation.

We will explore how creating opportunities for a clearer sense of the rights and obligations of marriage can improve the relationship.  We will also discuss new issues that are being raised in the prenup process and ways to address these issues.

1. Professional Conduct and Regulation

Learning Objectives to be addressed:

  • The importance of clarifying the client's goals.
  • Making sure the agreement is balanced.
  • Prenups and the significance of independent counsel.
  • What makes a prenup legally binding?
  • What can and cannot be included in a prenuptial agreement?
  • Business ownership and prenups.

2. Estate Planning.

Learning Objectives:

  • Ensuring Estate provisions are consistent with the client's goals and financial circumstances in the event of divorce or death
  • will be addressed.
  • Ensuring the accuracy of financial information.

Deborah Hope Wayne is a collaborative attorney and mediator who dedicates her professional life to helping people negotiate family and divorce matters and resolve conflict without court intervention. Ms. Wayne is also an Adjunct Professor of Collaborative Law at the Elisabeth Haub School of Law at Pace University (Pace Law School).  She is the immediate past President of the New York State Council on Divorce Mediation (NYSCDM) and the Chairperson of the Accreditation Committee.  She is a former member of the Board of Directors of the New York Association of Collaborative Professionals (NYACP) and is a trainer of collaborative practice for NYACP.  She is also a Certified Divorce Financial Analyst.

Ms. Wayne co-developed one of the first law school programs on collaborative practice in the United States. This year (2021) marks the twelfth year she has taught collaborative law at Pace Law School. She has also taught Matrimonial Skills at the law school in 2020.  Ms. Wayne attended Boston University where she received a Bachelor of Arts cum laude; the University of Grenoble, Grenoble, France; and earned her law degree from Pace Law School.

Ms. Wayne has published a book on prenuptial agreements entitled: Prenups and the Elephant in the Room: A Handbook for the prenup Process. The book is a guide to negotiating a prenup and is available on amazon.com.

Ms. Wayne has lectured on prenuptial agreements, collaborative law, mediation, power imbalances and conflict resolution at various institutions, including: St. John’s University, the Elisabeth Haub School of Law at Pace University, Fordham Law School, the New York State Office of Court Administration, the Academy of Professional Family Mediator, the New York State Council on Divorce Mediation and the International Academy of Collaborative Professionals.
