Join our Part II discussion with Georgia Kramer and Robert Jones on how to negotiate, draft and implement the division of retirement funds where we will be addressing the following:

  • IRA transfers must be Incident to a judgment of divorce.  What does that mean?
  • Can you freely transfer among retirement plans when dividing assets?
  • May the court sign a qdro which corrects errors in the stipulation of settlement?
  • Who is responsible for completing transfers of retirement assets?
  • Does state law about ownership of assets (like common law or equitable distribution) influence the tax consequences of dividing retirement assets?

Georgia D. Kramer is a Partner in the Family and Matrimonial Law practice group at Abrams Fensterman, LLP working out of the White Plains office. Ms. Kramer devotes her practice exclusively to matrimonial and family law, handling a variety of matters involving divorce, child support, custody, domestic violence, post-judgment enforcement, and visitation rights. Prior to joining Abrams Fensterman, Ms. Kramer was a founding member of a boutique family law firm in White Plains.

Ms. Kramer has more than five decades of legal experience. Recognized for her many accomplishments, she holds an AV Preeminent* peer review rating from Martindale-Hubbell and is the recipient of numerous awards for her work as a matrimonial attorney and pro bono service. The American Institute of Family Law Attorneys named her one of the “10 best attorneys in New York” and the Best Attorneys of America inducted her as a member. She has been designated as a New York Metro Super Lawyer since 2008.

A respected and active member of the New York legal community, Ms. Kramer is a member of the family law and taxation sections as well as the ethics committee of the Westchester County Bar Association. She belongs to the Westchester Women’s Bar Association and is a former chair of the association’s matrimonial committee. She is also an active participant in the Westchester County Alternate Fee Resolution Program as well as a member of the International Academy of Collaborative Professionals and the New York Association of Collaborative Professionals.

Ms. Kramer was a contributing writer for the book Strategies for Family Law in New York, 2012 ed., published by West/Thompson Reuters. She was the recipient of the AJC’s 2013 Judge Learned Hand Award for contributions to the legal profession and a recipient of the Corporate LiveWire award for Attorney of the Year in 2014 and the Corporate LiveWire Global award in 2016 in the category of tax.

Ms. Kramer earned a bachelor’s degree from Barnard College and received her Juris Doctorate from New York University School of Law. While pursuing her law degree, she served as editor of the New York University Law Review and belonged to the Order of the Coif. She also obtained a Master of Law degree in taxation from the university in 1983.

Ms. Kramer is admitted to practice law in the State of New York.


 Robert W. Jones, JD, MBA, PhD, worked as a business appraiser for more than a decade before obtaining his law degree. Then, after twenty years of experience preparing business appraisals, providing expert testimony, and advising matrimonial attorneys on equitable distribution, he joined a law firm specializing in matrimonial and family law. There, he used his background in finance to resolve financial matters and prepare the firm’s domestic relations orders. In 2023, he began collaborating with attorney Carolyn D’Agostino to prepare domestic relations orders and provide consulting services for matrimonial attorneys. Those services include:

 

• Preparation and submission of domestic relations orders
• Consultation services for settlement agreement language relating to pensions and retirement accounts
• Pension valuations
• Business appraisals
